BCCT OPEN FORUM: What You Need to Know about Litigation and Arbitration in Thailand

BCCT is seeking multiple co-sponsorship of THB 10,000 +VAT per company for this Evening Open Forum on Thursday 3rd October, 6-8.30pm at dusitD2 Samyan, Bangkok.

BCCT Legal & Taxation Working Group is delighted to invite you the 2024 Litigation and Arbitration Symposium. The event will be an open forum with four panel members. There will be no panel presentations. The panel members will be as below

Litigation and arbitration is a massive area. In Thailand, we have: 

  • Civil courts
  • Criminal Courts
  • The Courts of Appeal
  • The Supreme Court

There are also specialized courts:

  • The Labour Court
  • The Tax Court
  • The Juvenile and Family Court
  • The Intellectual Property and International Trade Court
  • The Constitutional Court
  • Other courts 

Note that the Tax  Court decides disputes between The Revenue Department or the Excise Department and tax payers. The Customs Department decides disputes regarding import duty 

Regarding arbitration, it is important to note the parties must agree that the dispute is to be resolved by arbitration, rather than court proceedings. 

Thailand has its own Arbitration Act which follows an international template. 

Arbitrations may take place between Thai parties or foreign parties. The parties may choose:

  • the rules that will apply to the arbitration, for example, the rules of the International Chamber of Commerce or the UNCITRAL (United Nations linked rules)
  • The law that will apply to the dispute, for example, Thai law, English law or New York state law
  • The arbitrators who will decide the case will be chosen by the arbitral authority, or the parties themselves
  • The parties can choose the venue for the arbitration, e.g. Bangkok, Singapore or Hong Kong.

Wherever the arbitration takes place, if it has to be enforced in Thailand, then it must be enforced through the courts of Thailand.

  • Advance payment is required to confirm your registration and if payment not made 24 hours before the event, your place will be passed on to the waiting list. No walk-ins.
  • Cancellations received less than 24 hours (1 day) and no-shows are NOT able to receive neither a refund nor credit.
  • Payment is required at the time of booking. At any other time will incur a higher fee
